September 12, 2006, Special Council Meeting Minutes
The Special Council Meeting of the Clarion Borough Council was held on September 12, 2006, at the Clarion Borough Offices.
President Wilshire called the meeting to order at 12:16 p.m.
Councilmembers present included Mr. Zerfoss, Mr. Herman, Ms. Leonard, Ms. Moore, and President Wilshire. Ms. Vavrek and Mr. German were absent. Ms. Freenock was also present. Chief Hall, Mr. Ragon, Mr. Stutzman, Solicitor French, and Mayor Stroup were not present.
President Wilshire stated the purpose of the meeting is to approve a resolution related to funding for the Clarion Area Authority.
Ms. Freenock commented it’s actually an ordinance and is slightly different than the one Council received last week in his/her packet. Keith Pemrick, the attorney for the Authority, wanted it to include some language about PUC actually having to approve the sale. That is the only change.
President Wilshire read Ordinance #2006-739, an Ordinance authorizing the guaranty of a loan to be made to Clarion Area Authority in the principal amount of $900,000 for 12 months at an interest rate of 4.75%, into the record. A copy of the Ordinance is attached to the Official File Copy of these minutes.
On a motion by Mr. Herman with a second by Ms. Leonard, adopting Ordinance #2006-739, an Ordinance authorizing the guaranty of a loan to be made to the Clarion Area Authority in the principal amount of $900,000 for twelve months at an interest rate of 4.75% per annum.
President Wilshire asked Ms. Freenock to explain what happens after it’s approved.
Ms. Freenock reported the Borough has to have a second publication, which indicates that Council did in fact adopt the Ordinance. Once that proof of publication is received, it, along with a signed copy of the Ordinance, the first proof of publication in reference to Council’s intent to adopt the Ordinance, and a copy of the Authority’s resolution will be sent to the Governor’s Center for Local Government. The documents are then open for inspection for 15 days. After the 15-day period, Ms. Freenock stated the Department will notify the Borough on whether or not any action has been taken. If none, then it becomes effective.
The motion carried after the following roll call vote: Mr. Zerfoss, yes; Mr. Herman, yes; Ms. Leonard, yes; Ms. Moore, yes; and President Wilshire, yes.
On a motion by Mr. Herman with a second by Ms. Leonard, the Special Council Meeting was adjourned at 12:19 p.m.
